Terms of Use

Last updated: 2025-09-17

Welcome to InSpire Canada Math Contest (the “Site”). By accessing or using our Site, services, and related products (collectively, the “Services”), you agree to these Terms of Use (the “Terms”). If you do not agree, please do not use the Services.

For how we collect, use, and protect personal data, please see our Privacy Policy. These Terms are provided for general informational purposes only and do not constitute legal advice.

If there is a conflict between these Terms and specific rules posted for a particular contest, the contest-specific rules will govern for that contest to the extent of any inconsistency.

1) Acceptance

These Terms form a binding agreement between you and InSpire Canada Math Contest, operated by InSpire Education Technology Inc. (“we”, “us”, or “our”).

You represent that you have the legal capacity to enter into these Terms. If you are under the age of majority in your jurisdiction, you may only use the Services with the consent and supervision of a parent or legal guardian. In that case, “you” also refers to your parent or legal guardian, who agrees to these Terms on your behalf and is responsible for your use of the Services.

2) Eligibility

You may use the Services only in compliance with all applicable laws and these Terms. Some Services (for example, specific contests or programs) may have additional eligibility rules, age limits, or geographic restrictions published on their pages. It is your responsibility (and, where applicable, your parent or guardian’s responsibility) to ensure that your participation complies with the laws of the place where you live and access the Services.

3) Accounts & Security

  • You must provide accurate, complete, and current information (for example, name, grade, school, city/province/country) and update it as needed.
  • Keep your login credentials confidential. You are responsible for all activity that occurs under your account, whether or not you personally perform the actions.
  • Notify us promptly of any suspected unauthorized use of your account or any security incident related to the Services.

4) Permitted Use

You may access and use the Services for your personal, non-commercial educational use, in accordance with these Terms and any rules posted on relevant pages (such as exam rules, coordinator guides, or contest instructions). You may not use the Services for any purpose that is unlawful or prohibited by these Terms.

5) Payments, Refunds & Taxes

  • Prices and fees are shown at checkout or on the relevant contest or product page and may change from time to time.
  • Payments are processed by approved payment providers. By submitting payment details, you authorize us and our payment providers to charge your selected payment method for all applicable fees and any taxes.
  • Refunds: Except where a different refund policy is clearly stated at the time of purchase, all fees and charges are non-refundable once registration is completed and/or any contest materials or account access have been provided, except to the extent a refund is required by applicable law.
  • You are responsible for any applicable taxes, duties, or similar charges arising from your purchases, except where we are required by law to collect and remit them.

6) Contests, Proctoring & Camera Use

Contest participation is subject to contest-specific rules (for example, eligibility, timing, qualified proctors, academic integrity requirements). By registering for or taking part in a contest, you agree to comply with all applicable contest rules and instructions.

To protect exam integrity and student safety, we may require online proctoring. During proctoring, your device’s camera and microphone may be activated, and your screen and certain network activity may be monitored in real time. You agree not to obstruct, disable, or misrepresent any proctoring process.

What may be collected during proctoring. Depending on the contest settings and technical setup, we may collect: (a) live video and audio of the test-taker and immediate surroundings; (b) still images or short clips for identity checks; (c) screen activity and basic device information (for example, browser, operating system, IP address, timestamps); and (d) proctor session logs and flags generated by proctors or automated systems.

Use & retention. Proctoring data is used only to verify identity, uphold exam integrity, investigate potential misconduct, and comply with legal obligations. Unless a longer period is required for investigations, appeals, or legal compliance, we aim to retain proctoring data for up to 180 days from the contest date and then delete or de-identify it.

Identity & environment. You may be asked to show a valid photo ID (where permitted by law) and to pan your camera to confirm that the testing environment is compliant (for example, no unauthorized materials or persons present). If you refuse required checks, do not cooperate with proctors, or breach contest rules, your contest results may be invalidated and your access to the Services may be suspended or terminated.

Proctoring requirements and data collection practices may vary by contest and by jurisdiction. Where required by law, we will seek additional consent from a parent or legal guardian and/or adjust proctoring practices. You (and, where applicable, your parent or guardian) are responsible for ensuring that your participation in any proctored contest is lawful in the place where you are located.

Personal data collected during contests and proctoring is handled in accordance with our Privacy Policy.

7) User Content & License

“User Content” includes any materials you submit or provide through the Services, such as answers, communications, feedback, or messages.

You retain ownership of your User Content. By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to host, store, reproduce, display, and otherwise use your User Content only for the purposes of operating, maintaining, protecting, and improving the Services, administering contests, supporting research and analytics (in aggregated or de-identified form where appropriate), and complying with legal obligations.

You represent and warrant that you have all necessary rights to submit your User Content, and that your User Content does not infringe any third-party rights, violate any law, or breach these Terms.

We do not undertake to review all User Content and are not responsible for it. We may, but are not required to, remove or disable access to any User Content that we believe violates these Terms, infringes any rights, or is otherwise objectionable, without prior notice. We are not responsible for restoring or returning User Content, so you should keep your own backups where necessary.

8) Prohibited Conduct

  • Cheating, sharing exam content (during or after a contest), or attempting to gain an unfair advantage.
  • Impersonating any person or entity, or misrepresenting your identity, grade, school, or proctor status.
  • Reverse engineering, scraping, or otherwise attempting to access or interfere with non-public areas of the Services or any security or technical protection measures.
  • Uploading or transmitting malware, illegal content, or content that is harassing, hateful, abusive, defamatory, or otherwise objectionable.
  • Circumventing or attempting to circumvent paywalls, access controls, or geographic restrictions.
  • Using the Services in any way that could disrupt, damage, or impair the functioning of the Services or others’ use of them.

9) Intellectual Property

The Services, including all content, logos, graphics, questions, solutions, text, code, and software, are owned by us or our licensors and are protected by applicable intellectual property laws. Except as expressly permitted by these Terms or by us in writing, you may not copy, reproduce, modify, distribute, publicly display, publicly perform, or create derivative works from any part of the Services.

Using the Services does not give you any ownership or rights in the Services or any content, other than the limited right to use them for personal, non-commercial educational purposes in accordance with these Terms.

10) Third-party Links

The Services may contain links or access to third-party websites, services, or tools that are not owned or controlled by us. These links are provided for convenience only.

We do not endorse, control, or assume any responsibility for any third-party content, products, services, privacy policies, or practices. Your use of third-party sites or services is at your own risk and may be subject to separate terms and policies between you and the third party.

11) Disclaimers

The Services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties and conditions of any kind, whether express, implied, statutory, or otherwise, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, quiet enjoyment, and non-infringement.

We do not warrant that the Services (including contests, questions, scoring, or results) will be uninterrupted, timely, secure, accurate, error-free, or free of harmful components. We may correct errors in contest questions or scoring or adjust results where appropriate, but we are not obligated to do so.

We do not provide professional advice (for example, legal, financial, or educational consulting), and we do not guarantee any particular academic, admission, scholarship, employment, or other outcome as a result of participation in any contest or use of the Services.

12) Limitation of Liability

To the maximum extent permitted by law, in no event will we (including our directors, officers, employees, agents, or affiliates) be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, or other intangible losses, arising out of or related to your access to or use of (or inability to access or use) the Services.

To the maximum extent permitted by law, our total aggregate liability for any claim arising out of or relating to the Services or these Terms will be limited to the greater of: (a) the amount you paid to us for the specific contest or Service that gave rise to the claim during the twelve (12) months prior to the event giving rise to the claim, and (b) CAD $50.

Nothing in these Terms is intended to exclude or limit any liability that cannot be excluded or limited under applicable law (for example, certain consumer protection rights).

13) Indemnity

You agree to defend, indemnify, and hold harmless us and our directors, officers, employees, agents, and affiliates from and against any and all claims, demands, actions, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Services; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any rights of another person or of any applicable law or regulation.

14) Suspension & Termination

We may suspend or terminate your access to all or part of the Services at any time, with or without notice, if we believe that you have violated these Terms, engaged in misconduct (including academic dishonesty), posed a risk to other users or to the integrity or security of the Services, or where we are required to do so for legal or operational reasons.

Upon termination, your right to use the Services will cease immediately. Provisions that by their nature should survive termination (for example, intellectual property rights, disclaimers, limitations of liability, indemnity, and governing law) will continue to apply.

15) Governing Law

These Terms are governed by and interpreted in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of laws principles. You agree to the exclusive jurisdiction of the courts located in Ontario, Canada, for any dispute arising out of or relating to these Terms or the Services.

If you are a consumer residing outside Canada, you may also have certain mandatory rights under the laws of your country of residence, and nothing in these Terms is intended to limit those mandatory rights.

16) Changes to Terms

We may update these Terms from time to time, for example to reflect changes in the Services or applicable laws. When we make material changes, we will update the “Last updated” date at the top of this page. Changes take effect when they are posted on this page, unless a later effective date is stated.

Your continued use of the Services after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Services.
